If you have information about, have witnessed or know something about a situation that should not have happened in our company – do not keep it to yourself. Your attitude helps all of us, especially when it comes to improving the quality of our work and increasing the safety of the operations related to the Port of Gdansk.

You can sign a notification or submit it anonymously – in both cases we ensure full confidentiality of the data, as well as due diligence in analysing the information provided. We also provide whistleblowers with full protection against retaliation and its negative consequences.

A whistleblower is a person who has information or reasonable suspicion of an actual or potential violation of the law in an organisation (within the meaning of Article 1(1) and (2) of the Act on the Protection of Whistleblowers of 14 June 2024, hereinafter: the ‘Act’) where they work or used to work, or with whom they maintain or have maintained official contact.

A whistleblower may be, for example:

  • a full-time employee;
  • a temporary employee;
  • a person providing work under a civil law contract;
  • an entrepreneur;
  • a proxy;
  • a shareholder or a partner;
  • a member of a body of a legal person or an organisational entity without a legal personality;
  • a person performing work under the supervision and direction of a contractor, subcontractor or supplier, including under a civil law contract;
  • a trainee;
  • a volunteer;
  • an intern;
  • an officer within the meaning of Article 1(1) of the Act of 18 February 1994 on pension provision for officers of the Police, the Internal Security Agency, the Intelligence Agency, the Military Counterintelligence Service, the Military Intelligence Service, the Central Anti-Corruption Bureau, the Border Guard, the Marshal Guard, the State Protection Service, the State Fire Service, the Customs-Security Service and the Prison Service and their families;
  • a soldier within the meaning of Article 2(39) of the Act of 11 March 2022 on the Defence of the Fatherland.

The person making the notification may be the person who became aware of the irregularities in a work-related context. A work-related context should be understood as the entirety of the circumstances related to the employment relationship or other legal relationship constituting the basis for the provision of work, as part of which information about the violation of the law was obtained. This means that the procedure also applies to persons in litigation before and after the employment or other legal relationship is established.

If violations and irregularities are identified or suspected, the whistleblower has the possibility to report them through the indicated reporting channels.

An employee of the company, a counterparty or other persons having knowledge of a violation of the law, can make a notification in writing anonymously or openly:

  • TRADITIONALLY – by placing the Notification in a sealed envelope containing only the note ‘Notification – do not open’, without indicating on this envelope the sender of the mail (data of the whistleblower), and sending it to the address: ZMPG S.A., Zamknięta 18, 80-955 Gdańsk. The whistleblower shall indicate in the notification his/her postal address and/or telephone number to confirm the correspondence address, if it is necessary;
  • ELECTRONICALLY – via a special electronic channel (we are working on it, please be patient).

The person reporting the violation (Whistleblower) is guaranteed anonymity and protection from possible negative consequences, as long as they act in good faith and do not provide false information.

The dissemination of slander, the reporting of false information or the transmission of information in bad faith is contrary to the rules adopted by the company and is prohibited.

If a notification is based on false or bad faith information, the proceedings shall be discontinued.

If required by generally applicable laws and when necessary from the perspective of the company’s interests, specific violations are reported to the competent public authorities.

The company has an Internal Notification and Follow-up Procedure based on the Act, which regulates specific violations of the law in ZMPG S.A. in the following areas:

  • corruption;
  • public procurement, with the exception of Violations of the law in relation to public procurement in the fields of defence and security within the meaning of Article 7, item 36 of the Act of 11 September 2019, Public Procurement Law, and offset agreements concluded on the basis of the Act of 26 June 2014 on certain agreements concluded in connection with the execution of orders of fundamental importance for state security;
  • financial services, products and markets;
  • anti-money laundering and terrorist financing;
  • product safety and compliance;
  • transport security;
  • environmental protection;
  • radiological protection and nuclear safety;
  • food and feed safety;
  • animal health and welfare;
  • public health;
  • consumer protection;
  • privacy and data protection;
  • security of ICT networks and systems;
  • the financial interests of the State Treasury of the Republic of Poland, local government units and the European Union;
  • the internal market of the European Union, including EU competition and state aid rules; and taxation of legal entities;
  • constitutional freedoms and rights of the human being and the citizen –  occurring in the relations of the individual with the public authorities and not related to the areas indicated in items 1–17;
  • the internal regulations in force in ZMPG S.A., established in the company on the basis of the provisions of the law and remaining in compliance with them.
